How to check registration of a company from the MCA website if a company is registered or not?

If any Company claims to be registered with MCA/Registrar of Companies (ROC), you may ask them for the CIN (Company Incorporation Number) which is allotted by ROC (each registered company has a unique CIN allotted). If you could not find the Company Name either using CIN or name provided, you can be sure that it’s not registered with Registrar of Companies/Government of India.  Only LLP, Public Company Limited & Private Limited Company Status can be obtained using the MCA website. Status of individual registered as Partnership Firm or Sole Proprietorship cannot be obtained through the MCA website.

Rules for Choosing the Name for a New Company

The Registrar of Companies (ROC) across India expects a candidate to follow a few naming guidelines. Some of them are personal, which means that approval can depend on the opinion of the official handling your application. However, the more firmly you follow the rules listed below, the better your chances of approval.

  1. Unique Component:

In Flipkart Internet Private Limited, Flipkart is the different component. Now, once taken, the name Flipkart will not be given to any new business within the suffix Internet or even related categories (Online Solutions and E-commerce, for example). But there is some subjectivity, too. Some RoCs cannot even approve the name Flipkart Chemicals Private Limited, reasoning that the e-commerce brand Flipkart is too well-known. Similar sounding names would also be rebuffed (so no Flipkart ).

  1. Blacklist:

Abbreviations, adjectives and generic words are rejected. So BBC or XYZ would be dismissed, as would Good Quality Biscuits. The words bank, exchange and stock exchange, unless approved by RBI or SEBI, would also be rejected.

  1. No Common Trademark:

There should not be a certified trademark by the same name on the HYPERLINK “http://ipindia.nic.in/” \t “_blank” IP India website. If there is one, the name can only be approved if you are able to get a No-Objection Certificate from its owner authorising you to use it.

  1. Descriptive Component:

In Biocon Research Private Limited, the word ‘Research’ defines the business the company is into. You cannot have ‘Research’ in your brand name if you’re, say, in the logistics or restaurant business.
